How to Get Zimbabwe Citizenship

Under Article 38(2) of the Constitution, any person who has been continuously and lawfully resident in Zimbabwe for at least ten years and who satisfies the conditions prescribed by an Act of Parliament is entitled to apply to be registered as a Zimbabwean citizen.

A child is automatically a Zimbabwean citizen by birth if they were born in Zimbabwe and one of their parents or grandparents was a Zimbabwean citizen (Article 36(1)). They are also a Zimbabwean citizen if they were born outside Zimbabwe and at the time of birth, one of their parents was a Zimbabwean citizen and was ordinarily resident in Zimbabwe (Article 36(2)).

Technically, Article 36(3) of the Zimbabwean Constitution states that ‘A child found in Zimbabwe who is or appears to be, less than 15 years of age, and whose nationality and parents are not known, is presumed to be a Zimbabwean citizen by birth.’ Such a child would, therefore, be entitled to the prompt provision of a birth certificate under the terms of the Birth and Death Registration Act and section 5 of the Zimbabwean Citizenship Act.

Article 38(3) also provides that a child who is not a Zimbabwean citizen but is adopted by a Zimbabwean citizen is entitled, on application, to be registered as a Zimbabwean citizen. This is supported by section 7 of the Citizenship Act, which states that foreign national children who are adopted by Zimbabwean citizens are entitled to citizenship from the day the birth is registered in terms of the Children’s Act and the Birth and Death Registration Act.

Under Article 38(2) of the Constitution, any person who has been continuously and lawfully resident in Zimbabwe for at least ten years and who satisfies the conditions prescribed by an Act of Parliament is entitled to apply to be registered as a Zimbabwean citizen.
